Desiree Cummings represents institutional and individual investors in complex securities litigations and breach of fiduciary duty actions.

Desiree has extensive experience litigating complex civil actions. Desiree focuses her practice on prosecuting complex securities fraud and breach of fiduciary duty actions on behalf of investors. She represents clients in federal and state courts and has been an instrumental member of litigation teams that have achieved significant recoveries for investors, including:

In re Dell Technologies Inc. Class V Stockholders Litigation, a breach of fiduciary stockholder litigation filed in the Delaware Court of Chancery, which resulted in a recovery of $1.0 billion.

In re Viacom Inc. Stockholders Litigation, a breach of fiduciary duty stockholder litigation filed in the Delaware Court of Chancery, which resulted in a recovery of $122.5 million.

In re Pattern Energy Group Inc. Stockholders Litigation, a breach of fiduciary duty stockholder litigation filed in the Delaware Court of Chancery, which resulted in a recovery of $100 million.

In re Waste Management Securities Litigation, a securities class action filed in the United States District Court for the Southern District of New York, which resulted in a recovery of $30 million.

In re Jernigan Capital Inc. Securities Litigation, a securities class action filed in the United States District Court for the Southern District of New York, which resulted in a recovery of $12 million.

Before joining the Firm, Desiree was a Partner at Robbins Geller Rudman & Dowd LLP where she represented institutional and individual investors in securities and breach of fiduciary duty cases, and consumers in data breach litigation.

Before Robbins Geller, Desiree served for several years as an Assistant Attorney General with the New York State Office of the Attorney General’s Investor Protection Bureau. As an Assistant Attorney General, Desiree played a key role in the office’s Residential Mortgage-Backed Securities investigations and litigations, leading to recoveries exceeding $1.6 billion for the State of New York.

Desiree began her career as a litigator at Paul, Weiss, Rifkind, Wharton & Garrison LLP where she spent several years defending major financial institutions, a pharmaceutical manufacturer, and public and private companies in connection with commercial litigations and state and federal regulatory investigations.

Desiree earned her J.D. from the University of Michigan Law School and holds a B.A. in Philosophy, Politics, and Law from Binghamton University.
